Thank you for choosing Server.HK as your hosting provider. By signing up for our services, you agree to comply with and be bound by the following Terms of Service. Please read these terms carefully before using our services.
2. Service Description
Server.HK offers Virtual Private Server (VPS) hosting services and Dedicated Server hosting services for both individuals and businesses. Once the VPS or Dedicated Server is activated and made available for use, the transaction is considered complete, and no further refunds will be issued unless under the specific circumstances outlined in our refund policy.
3. Payment and Billing
a. Payment: All payments for Server.HK services are processed in either HKD (Hong Kong Dollars) or USD (United States Dollars). We accept various payment methods, including credit cards, PayPal, Stripe, Alipay, and cryptocurrency.
b. Billing: Your billing cycle starts on the date you sign up for our services. We offer monthly, quarterly, and annual payment options. You will receive invoices via email, and it is your responsibility to ensure timely payment.
4. Money Back Guarantee
We strive to provide exceptional service to our customers. If you are not satisfied with our VPS service, we offer a 7-day no-questions-asked refund policy. However, refunds will only be issued within the first 7 days after successful activation and delivery of the VPS. Once the VPS is activated and the service is available to the customer, the transaction is considered finalized, and no further refunds will be issued.
Exclusions: Domain registration fees, SSL certificates, and any additional add-ons are non-refundable.
Dedicated Servers: No refund policy applies to Dedicated Servers under any circumstances.
5. Service Level Agreement (SLA)
a. Uptime: Server.HK guarantees 99.9% network uptime. In the event of any downtime beyond this guarantee, we will provide compensation as outlined in our SLA policy.
b. Performance: While we strive to provide optimal performance, factors such as software configuration and usage may affect server performance. Server.HK is not responsible for any performance issues arising from client-side actions or usage beyond the service specifications.
6. Acceptable Use Policy (AUP)
a. Prohibited Activities: Clients are strictly prohibited from engaging in any illegal or abusive activities, including but not limited to hacking, spamming, phishing, or distributing malware.
b. Resource Usage: Clients must ensure their resource usage does not negatively impact the server's performance or other clients' experiences.
7. Data Protection and Privacy
a. Confidentiality: Server.HK respects your privacy and treats all information provided by you as confidential. We will not disclose or sell your personal information to third parties unless required by law.
b. Data Backup: While we strive to maintain adequate backups, it is ultimately the client’s responsibility to regularly back up their data. Server.HK shall not be held liable for any data loss or damages incurred.
8. Termination and Suspension
a. Termination: Either party may terminate the service at any time by providing written notice. No refunds will be issued for termination before the end of the billing period. Please note that once services are delivered and activated, the transaction is considered complete.
b. Suspension: In case of a violation of our Terms of Service, Server.HK reserves the right to suspend or terminate the services without prior notice.
9. Governing Law and Jurisdiction
These terms shall be governed by and construed in accordance with the laws of Hong Kong. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
10. Amendments
Server.HK reserves the right to modify these Terms of Service at any time without prior notice. Continued use of our services after any such changes constitutes your acceptance of the modified terms.
11. Acknowledgment of Service Completion
By purchasing and activating our VPS or Dedicated Server service, you acknowledge that delivery of the service is complete and that the transaction is finalized. Any issues regarding the functionality or service provided should be reported within the first 7 days of activation to be eligible for a refund under our Money Back Guarantee for VPS services.
