1. Acceptance of Terms By purchasing, activating, or using any Server.HK service (including VPS, Cloud VPS, Dedicated Servers, or related add-ons), you agree to be bound by these Terms of Service (“TOS”), our Acceptable Use Policy (“AUP”), and all applicable policies. Continued use after any update constitutes acceptance of the revised terms.

2. Services Provided Server.HK provides Virtual Private Servers (VPS), Cloud VPS, and Dedicated Server hosting. Services are considered fully delivered and the transaction complete upon activation and availability to the customer.

3. Service Rates & Changes You acknowledge that initial rates and charges are communicated at signup. Server.HK reserves the right to adjust rates prospectively. Promotional offers are subject to maintaining cost structures and supplier pricing.

4. Payment & Billing

  • Payments are accepted in USD or CNY.
  • Accepted methods: Credit/Debit Cards, PayPal, Stripe, Alipay, and cryptocurrency (USDT, Bitcoin, etc.).
  • Billing cycles: Monthly, Quarterly, Semi-Annual (6 months), or Annual — all auto-renew unless cancelled via your client area before the renewal date.
  • Payments are due in advance. Late payments may result in service suspension or termination.
  • All fees are subject to applicable taxes. Billing disputes must be reported within 30 days of the invoice date. Disputing valid charges with your payment provider may incur an administrative fee of USD 100.

5. Refund Policy Server.HK is committed to customer satisfaction, but due to the instant nature of server delivery, refunds are strictly limited:

  • VPS / Cloud VPS: 3-day unconditional money-back guarantee. Refund requests must be submitted via ticket within 3 days of activation.
  • Dedicated Servers: No refunds after activation. Exception: Plans explicitly marked with “12-Hour Refund Policy” qualify for an unconditional 12-hour money-back guarantee — refund request must be submitted via ticket within 12 hours of activation and delivery.

Service Delivery & Transaction Completion Upon activation and delivery of the service, the transaction is deemed complete, the service is fully rendered, and the customer has immediate access and usability. Any subsequent refund requests or chargeback attempts after activation (except under the above Money-Back Guarantee) will be considered invalid. Customers agree that delivery constitutes final acceptance of the service.

Non-refundable items: Setup fees, add-ons, licenses, domain names, SSL certificates, and cryptocurrency transaction fees. Refund processing: Approved refunds are returned to the original payment method within 7–14 business days.

6. Service Level Agreement (SLA) We aim for 99.9% network uptime (excluding scheduled maintenance, force majeure, or client-side issues).

  • Downtime compensation: Service credit only (no cash refund).
    (a) 0.1%–1% downtime: 5% of monthly fee credit
    (b) 1% downtime: 10% of monthly fee credit
  • Exclusions: Scheduled maintenance (advance notice provided), hardware/software updates, DDoS attacks, legal actions, or client misconfiguration.
  • Requests for credit must be submitted within 5 business days of the incident. SLA does not apply if your account is in breach or overdue.

7. Port Restrictions For security reasons, outbound ports 25 (SMTP), 465/587 (Secure SMTP), 389 (LDAP), 3389 (RDP), 111 (RPC), 137–139/445 (NetBIOS/SMB) are blocked by default. Unblock requests may be reviewed case-by-case.

8. Proof of Payment Card Ownership To prevent fraud, we may request valid photo ID to verify card ownership for online payments. All personal information is handled in accordance with our Privacy Policy.

9. Cancellation & Termination

  • You may cancel anytime via your client area (no refund for unused period).
  • We may suspend or terminate services immediately for AUP/TOS violations, non-payment, security risks, or abuse — no refunds will be issued.
  • Upon termination, access ends immediately; data may be deleted without recovery.

10. Limited Liability Server.HK is not liable for indirect, consequential, incidental, or punitive damages (including data loss, business interruption, or lost profits). Liability is limited to the amount paid in the preceding 30 days.

11. Force Majeure We are not liable for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, war, government orders, pandemics, power outages).

12. Disclosure to Authorities We may disclose customer information (including IP addresses, account details, usage logs) to law enforcement or regulators when required by law, court order, or to prevent fraud/crime.

13. Support Boundaries Support is provided 24/7 via ticket system only. We assist with server hardware/network issues but not application-specific problems (e.g., software configuration, website coding).

14. DDoS & Security Responsibility Customers are responsible for securing their servers against DDoS, malware, or unauthorized access. Upon notification of an attack (inbound or outbound), we may restrict access during investigation. Violations may result in suspension or termination without refund.

15. Privacy We collect and process personal data (e.g., email, payment info, IP) solely to provide services, process orders, and communicate. Data is protected during transmission (SSL/TLS) and not sold to third parties except as required by law or fraud prevention. You have rights to access, rectify, or erase your data (subject to legal obligations).

16. Amendments We reserve the right to update these TOS at any time. Changes will be posted here and emailed to customers. Continued use constitutes acceptance.

17. Governing Law These terms are governed by the laws of Hong Kong. Disputes are subject to the exclusive jurisdiction of Hong Kong courts.

This Acceptable Use Policy (“AUP”) is an integral part of the Server Rental Agreement and applies to all customers using Server.HK services (VPS, Cloud VPS, Dedicated Servers, etc.). By using our services, you agree to comply with this AUP and our Terms of Service.

Server.HK supports the free flow of information on the Internet and does not actively monitor customer content under normal circumstances. However, we reserve the right to remove, restrict, or suspend access to any material or service that, in our sole discretion, is illegal, exposes us to liability, or violates this AUP. We may cooperate with law enforcement or third parties in investigations of suspected violations.

Purpose of this AUP

  • Protect the reliability, security, and performance of our network
  • Safeguard the privacy and security of our customers and other Internet users
  • Comply with applicable laws
  • Maintain our reputation as a responsible service provider
  • Encourage responsible Internet use and discourage activities that degrade service quality

Prohibited Activities

The following activities are strictly prohibited. This list is illustrative and not exhaustive:

  1. Illegal Activities Using the service for any unlawful purpose or to support illegal activities (e.g., fraud, money laundering, drug trafficking, terrorism-related content).
  2. Child Exploitation Any content or activity involving child pornography, child sexual abuse material, grooming, or harm to minors.
  3. Violence & Threats Transmitting threats of violence, encouraging harm to persons or property, or inciting violence/terrorism.
  4. Harassment & Abuse Stalking, bullying, doxing, or harassing individuals or groups.
  5. Spam & Unsolicited Email Sending unsolicited commercial email (UCE), bulk unsolicited email, or engaging in email/news bombing. Outbound ports 25/465/587 are blocked by default to prevent abuse.
  6. Fraud & Deception Phishing, scams, fake offers, pyramid/Ponzi schemes, chain letters, impersonation, or forgery (spoofed headers, fake identities).
  7. Intellectual Property Infringement Unauthorized distribution of copyrighted material, trademark violations, patent infringement, or piracy.
  8. Unauthorized Access & Hacking Attempting unauthorized access, probing/scanning vulnerabilities, brute-force attacks, or distributing hacking tools.
  9. Malware & Network Abuse Distributing viruses, ransomware, trojans, spyware, botnets, DDoS attacks, or any code that damages systems or disrupts networks.
  10. Prohibited Content & Services
    • Stresser/booter services
    • Bulletproof hosting
    • Cryptojacking/mining without consent
    • Hosting illegal streaming/torrent trackers (infringing content)
    • Doorway/bridge pages for SEO manipulation
  11. Resource Abuse Excessive CPU, memory, disk I/O, or bandwidth usage that negatively impacts other customers or the network.

Customer Responsibility

You are fully responsible for all activity on your account, even if performed by third parties (employees, contractors, guests, etc.). You must secure your account with strong passwords and take reasonable steps to prevent unauthorized access.

Enforcement & Penalties

Violations may result in:

  • Written or verbal warning
  • Temporary suspension
  • Immediate termination without refund
  • Reporting to law enforcement
  • Administrative fee of RMB 200 or USD 30 (whichever is applicable) for violations involving illegal websites, spam, or other serious breaches

We prefer to notify customers of minor issues and allow correction, but serious, repeated, or flagrant violations will lead to immediate termination.

If you believe a Server.HK customer is violating this AUP, please report to: abuse@server.hk We investigate credible reports promptly.

Amendments

We may revise this AUP at any time. Changes will be posted here and emailed to customers. Continued use of services after changes constitutes acceptance.

ICP Filing Exemption Hong Kong servers do not require ICP filing or ICP license for operation within Hong Kong jurisdiction. Server.HK provides no representation or guarantee that use of our Hong Kong services exempts you from any regulatory requirements in Mainland China.

If your website, application, or service is directed at users in Mainland China (including but not limited to domain resolution in China, content primarily targeting Chinese audiences, advertising in China, or any activity that may trigger PRC regulatory oversight), you are solely responsible for complying with all applicable laws and regulations of the People’s Republic of China, including obtaining an ICP license or any other required permits from the Ministry of Industry and Information Technology (MIIT) or other authorities.

Content & Use Restrictions for China-Related Activities You may not use Hong Kong servers to host, transmit, or make accessible any content or service that violates the laws of the People’s Republic of China, including but not limited to:

  • Politically sensitive, subversive, or state-secrets-related material
  • Gambling, lottery, or betting services
  • Pornography, obscene material, or adult content
  • Unauthorized circumvention tools (e.g., commercial VPN/proxy services targeting Mainland China users)
  • Any content deemed harmful to national security, public order, or social morality under PRC regulations

No Liability for PRC Compliance Server.HK shall not be liable for any regulatory actions, fines, IP blocking, domain seizure, service disruption, or other consequences arising from your use of Hong Kong servers in relation to Mainland China. You assume full responsibility and liability for compliance with PRC laws and regulations.

Violation of this clause constitutes a material breach and may result in immediate suspension or termination of services without refund or prior notice.
